This isn't correct Ronnie. Your non-immigrant status does determine whether you are a Resident alien or a non-resident alien for tax purposes.
Classic example is that while you are on F1 /OPT you don't have to pay social security and medicare.
Immigration and Tax Filing are not at all related.

It was nice to touch-base with some of the DC rally veterans and share our experience. And also to discover some neighbors :)
State chapter meets are a nice opportunity to meet people and build your network - which may prove very useful to you in the future. People who skip the meets don't know what they're missing.

I live in a small town and work for fortune 100. Last month I saw some 10 Indian families in my small town and wondered what they are doing here? There are only two big insurance companies here and the other one does not have any H1bs. In my company there are four H1bs.
When I talked with them, they all came here for the first time from Accenture India. It was interesting to know that those guys are team leads and PMs back in India, but are mere programmers here. They say, they are not involved in any managerial or design activities. All they were given instructions from the perm employees on how/what to do. When discussed more, they said that is how Indian consulting and American companies work. We are PMs and leads only in India, but not when we are deputed to US. But if we go to UK/AUS, then we do the real PM job but not in US. Also 80% of Indian companies revolve around US projects.
The reason for me to say this now is I was thinking all these days that I lost big opportunity because I did not move back to India in right time. This is not true. Even if I decide to move back now, I should be able to get Sr.PM job. I learnt a lot from those guys about the Indian market. After that I felt the only thing I missed is Indian food.

There is also a possibility that in future you marry a person who is already here .. maybe on H1 or GC or a citizen . Since you are already going through a divorce I am sure if you marry again you would want to meet and understand your next future spouse thoroughly before marrying .
I can understand your situation . My personal advise is take it as it comes. Get the current situation over with first . As for your questions it has already been answered above.

Though this may be off topic, it is related to travel and NIV.
I booked tickets for my inlaws travelling on a tourist visa in Jet Airways - Chennai to JFK with layover in Brussels.
Now, when I ask people everyone say they travel by Lufthansa, Air India, Emirates etc... but I have not found anyone who has travelled by Jet Airways.
Just wanted to know if anyone has travelled via Jet Airways and their experience at the Brussels Airport, if it was smooth. My Inlaws do not speak English and this is the first time they are travelling.

I believe you are in New York. Next time try the direct flight from Mumbai to Newark. I heard thats the best my friend just tried it and he was going gaga about it. I am sure your inlaws can manage Chennai to Mumbai. What are the chances u can find someone who can speak Tamil ,Telgu in Mumbai than in Brussles or any other stopoever in Europe. :-)

One of my coleagues just got another FP notice yesterday. Did any July 2007 filers got second FP notice this year ? Does it mean that things are moving ?Please share your views.

Speaking of my personal experience, Yes, you can get an emergency appointment as returning h1b's are eligible for such appointments. Just send an email directly to the consulate and request for emergency appointment stating that you have to return to your project. I have done it before
It is advisable to carry all the LCA's, just in case, though the VO might just look at the current one. I am sure you will be taking all the other docs required.

No problem with expired i-94. Just inform them about I-485 filing. I did it without any problem.

How can you file concurrent I-140 and I-485 if PD is not current, meaning country is retrogressed? You can't file I-485. You can file I-140 only and wait PD to become current to file I-485.
CP requires police certificates, therefore one needs to go back to home country in advance of interview to get it. I think it also needs police certificates from all place resided since age ?? (16 or 18??). All CP but not all AOS gets interviewed.
There is nothing to be scared of in the interview. If you are skilled immigrant from any country and your case is genuine, what are you scared of in the consular interview? Attorneys here will always ask you for I485, sure it helps most people than those filing CP , but there is also economic advantage to attorneys suggesting this option.

My old attorney was appointed by my old employer but after I left my old company, my old attorney was working as my personal attorney and her contract with my old company was also over. and I kind of have good understanding with him. He was helpful in general scenarios as well.
But I am not sure whether I should switch the attorney. My worry is what if I tell my old attorney that I am doing G28 to new attorney from new employer and G28 form never reach USCIS file? then all the correspondence will goto my old attorney.... what will happen in those scenario?

Applying for premium processing with Company C seems to be best option. However sometimes premium processing takes more than 15 days to get a result. Since Company B has indicated that they will terminate my employment by the end of this month (less than 15 days from now), I may not have the option of resigning from Company B, before getting Company C's approval.
If B terminates my employment, and my transfer to C is still Pending, what will happen in such a case ?
You can start working for Employer C as and when you have the receipt notice for C's transfer. Just make sure, you file for transfer before termination. You have all the documents that is required for H1 transfer, dont worry about it.
